Making your Payment

ben-de-lisi.com is the trading name of Abacus Direct Ltd. As a user of this site you acknowledge that any transaction you make is subject to our terms and conditions below. Please:

All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions. Following receipt of your order we will send you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order acceptance from ben-de-lisi.com. Acceptance of your order and the completion of the contract between you and us will take place on dispatch of the products ordered unless we have notified you that we do not accept your order or you have cancelled it. We accept all major credit/debit cards - except American Express. The price for the goods will be as stipulated on the website at the time when you place your order. If due to an error or omission, the price published for the goods on our website is wrong, we will inform you of the correct price and give you an opportunity to either cancel or proceed with the order at the correct price.

Shipping and Handling

Where we offer free standard delivery on all products to UK mainland addresses, this is for week days only and does not include weekend delivery. Deliveries to the Highlands and off shore addresses are available upon request at extra charge. If the goods are returned as ‘Non Warranty’ i.e. you have changed your mind; you will be responsible for the cost of, and safe return of, all items to us within 7 working days from delivery. The Goods should be returned in their original packaging and in an unused and re-saleable condition. Your order for goods is subject to availability. If we are not able to supply the goods to you for any reason after 28 days, we will on request reimburse you for those goods. However, we will not be responsible for compensating you for any other losses which you may suffer if we do not supply goods. When our carriers deliver the goods, they will require you to sign for them. If neither you, nor your representative are able to receive the goods, our carrier will leave a card to advise that they will attempt the delivery again, or requesting you to contact them or visit their nearest depot to collect your order. If they are unable to deliver on the second attempt, you will be charged a further £12.50 for a third and every subsequent attempt. Should this situation arise we will contact you to collect your payment , the couriers will not release the goods until we have confirmed that payment has been received. Items are usually dispatched within 2 working days. We make every effort to deliver goods within the estimated dispatch timescales, however delays are occasionally inevitable due to unforeseen factors. We are under no liability for any delay or failure to deliver products within estimated timescales caused by circumstances beyond our reasonable control. In accordance with the Distance Selling Regulations all orders will be fulfilled within a maximum of 30 days or a full refund will be issued. If you have received any email from us confirming that your goods have been despatched, please let us know by replying to our email if you have not received your order within 3 working days. Deliveries are usually made between 8am and 6pm on weekdays. It is not possible to enquire about a delivery until the following day. Delivery is arranged on your behalf as a courtesy and forms no part of our contract to supply goods within a specified timescale.

Security is probably one of the most significant concerns for both the consumer and the merchant during an online transaction. In reality an online transaction is probably more secure than a card transaction in a shop or conducted over the telephone or by fax. Information transmitted online is encrypted using complicated algorithm combinations unlike these other methods that use standard medium coding.
The WorldPay Select payment gateway uses a combination of both established and innovative techniques to ensure the security and integrity of all sensitive data, protecting both the merchant and their customers.

All communication between the customer and WorldPay is encrypted to the maximum strength supported by the customer's browser using: TLS or SSL (security)
Our public web servers are certified by Thawte, a public Certificate Authority ensuring that customers and merchants alike can have confidence that nobody can impersonate WorldPay to obtain confidential information.
All communication between the merchant and WorldPay, including the details of the purchase are encapsulated using our own encrypted and digitally-signed protocol. This uses a combination of standard methods such as PGP, RSA and MD5 to ensure that the information passed is secure and tamper-proof.
Data storage on WorldPay systems, and the communication between WorldPay and the worldwide banking networks, is regularly audited by the banks themselves. There are no vulnerabilities or 'back doors' in any WorldPay systems. We ensure that we stay up to date with the latest versions of any third-party code we use, and continually review our own proprietary code, using current best practice at all times.
In addition card issuers protect cardholders from fraudulent use of their card in a card not present environment, such as over the Internet or telephone. As the customer did not sign for the goods they have the absolute right to demand a chargeback if those goods didn't arrive or the card was used fraudulently.
WorldPay also insure all of our merchants against the risk of them going out of business. If one of WorldPay’s online merchants goes into receivership WorldPay protects the cardholder by directly refunding any debits onto their card.

These two combined allow complete protection for a cardholder.

Our returns and refunds policy is in accordance with the EU Distance Selling Directive which came into force in October 2000 and is part of UK law under the Consumer Protection (Distance Selling) Regulations 2000. This law applies to all transactions within the UK where a consumer does not meet the seller. Contracts between businesses are not governed by these regulations. Consumers have the option to change their mind and cancel any order between the time of placing it and 7 working days starting from the day after delivery. Cancellation must be made in writing by recorded delivery post to ben-de-lisi.com, Abacus House, Jubilee Court, Copgrove, HG3 3TB or by email (info@ben- de-lisi.com). To help us process your must include your name, address and order reference number. Once you have cancelled the contract you have a legal "duty of care" to take good care of the goods and return them to us at your expense. In accordance with the Distance Selling Regulations we will refund to you the full amount paid for the goods within 30 days of receipt of the notice of cancellation. We do not offer a collection service, all return postage charges will be the responsibility of the customer.

If you wish to complain

All disputes arising out of or in connection with the contract shall be governed by English law and the buyer accepts the jurisdiction of the Courts of England. In the unlikely event that you should feel the need to complain, we will try our best to reach a satisfactory resolution for you.

Receipt of goods

Please check goods thoroughly before signing to say that you have received them in good condition. The delivery driver may try to rush you. Just ignore them and make a simple check for transit damage. This is very important as a claim against the carriers can only be made if the damage has been notified to the driver. Do not amend the signature sheet in any way. The carriers will not accept any subsequent claim for goods signed for as "unchecked". Please note if you declare that you have received your item in good condition, it is difficult to later claim that your goods were in fact damaged in transit. If you do receive goods which on inspection are unacceptably and substantially, damaged, refuse delivery of it. Do not sign for it and contact us immediately on 0333 200 1242, giving a clear reason for refusal. We can then arrange for replacement goods to be sent out to you as soon as we receive and inspect the returned goods. You will not be charged for return unless following our inspection, the goods are found to be undamaged.

Special Orders

Special orders made to customers' specifications are excluded from the cancellation provisions of the Consumer Protection (Distance Selling) Regulations 2000. All of our Ben de Lisi furniture is handmade to order and as such is deemed to be special order.
However,in the event that a special order item is found to be faulty please contact us either by telephone, email or post. We may then offer you an exchange or a monetary refund dependant on the nature of the problem. Original delivery costs will be refunded only if the item is faulty, damaged in transit. Returned parcels remain the responsibility of the customer until safely received by us. The Company does not pay "return" carriage unless an item is faulty.

We do not disclose your information to any third parties. We will only use the information that we collect about you lawfully (in accordance with the Data protection Act 1998). We collect information only for the following 2 reasons, firstly, to process your order, and second, to provide you with the best possible service.

If we e-mail you in the future you will have the option to unsubscribe to future e mails. We will not pass on your e-mail address to other organisations unless you have given your consent. We will never collect sensitive information about you without your explicit consent.

The information we hold is to the best of our ability accurate and based solely upon information we receive from you and it remains as up to date as it can be. You can check what information we hold about you, by writing to us. We will delete or correct any inaccuracies promptly. This information is held securely.

If you do give us personal information, either by filling out an order form or using the contact form, then you can be assured that this information will only ever be used in the way that you specify. Any sensitive data that you might supply can be assured to be safe. It is at no point stored in any form of electronic retrieval system to which persons outside Abacus Direct Ltd could gain access.

If your address exists in our mailing list database, every message you receive from it will contain a simple on-click removal facility, which results in immediate removal of that address from the database.

If you would like to inspect the data that we hold which respects to you, then please write, with proof of ID and send a stamped addressed envelope, with a cheque for £10 to cover administrative costs to;
